9. Online Orders
(a) Where an order indicates a license is being purchased:

However, Company does not guarantee the availability of any payment method at any moment and Company may add, remove or suspend any payment method temporarily or permanently at Company's sole discretion. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Website and to promptly update account and payment information, including email address, payment method, and payment card expiration date, in order to complete your purchases and contact you as needed. Sales taxes are included in the price. We may change prices at any time. All payments shall be in CAD.
You agree to pay all charges or fees at the prices then in effect for your purchases, and you authorize us to charge your chosen payment provider for any such amounts upon making your purchase. If you authorize PayPal for future purchases, this Website will store an identification code linked to your PayPal account, which will authorize this Website to automatically process future payments or recurring installments of past purchases. PayPal's authorization can be revoked at any time, either by contacting us or by changing the user settings offered by PayPal.
We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment. We also reserve the right to refuse any order placed through the Website.
11. Return and Refund
No Refunds: All sales of apartment proposals by Housing Hawk are final. No refunds shall be issued once a proposal has been delivered to the client, with the sole exception as outlined herein.
Exception for Unavailability: The only exception to the no-refund policy is if the client contacts the landlord or property management of the proposed apartment within 24 hours of receiving the proposal from Housing Hawk and is unable to secure the apartment due to its unavailability. In such cases, the client is entitled to receive one additional apartment proposal at no extra charge.

12. Communications with landlords / property managers
Once a rental property proposal has been delivered to the Client by Housing Hawk, it is the sole responsibility of the Client to initiate contact with the landlord using the contact information provided in the accompanying certified report. The Client agrees that following the submission of a proposal, taking action to communicate with the landlord constitutes a critical part of the rental process, and failure to do so is outside the responsibility of Housing Hawk. The Company is not liable for the Client's delay or failure to contact the landlord
13. Responsibilities post-service
Housing Hawk’s responsibilities with respect to the services provided to the Client are fulfilled once all apartment proposals corresponding to the selected bundle have been sent. Housing Hawk is not responsible for any subsequent issues, including but not limited to disputes with landlords, management of lease transfers, lease negotiations, or communications regarding the apartment. All further actions following the submission of the final proposal are the sole responsibility of the Client.
By booking an apartment through the Housing Hawk website (Properties page), the client acknowledges and agrees to the following terms:

Accompaniment Until Lease Signing: Housing Hawk commits to accompanying and assisting the client up to the point of lease signing with the landlord or property manager. This accompaniment includes providing support and guidance in understanding the terms of the lease, facilitating communication between the client and the landlord, and assisting in the arrangement of lease signing.

Limitation of Responsibility Post-Lease Signing: Once the lease has been signed by the client, Housing Hawk's responsibility and involvement in any matters related to the apartment, the lease, or the relationship between the client and the landlord will cease. The client acknowledges that Housing Hawk shall not be held responsible for any issues, disputes, damages, or liabilities that may arise post-lease signing, including but not limited to the condition of the apartment, discrepancies with the lease terms, or any other matters related to the occupancy and use of the apartment.
14. Apartment proposal response deadline
Upon submission of a rental property proposal by Housing Hawk ("Company") to you ("Client") in the contexts where the apartment Visits or Search & Inspect services were selected, you are required to acknowledge receipt and indicate your acceptance or rejection of the proposal within twenty-four (24 hours) hours of the proposal being sent. Failure to respond within this time frame will result in the proposal being withdrawn and no longer available. Each proposal submitted by the Company and not responded to within the specified twenty-four (24-hour) period will be considered as one (1) utilized proposal from your bundle/package with the Company. Please note that timely response is essential for the effective rendering of our services and to ensure a continuous opportunity for all clients seeking rental properties
15. Legal Advice Disclaimer Clause
Please note that any advice or information provided by Housing Hawk, including but not limited to suggestions on apartment selections, negotiations, or any other guidance related to the leasing or purchasing of properties, is not intended to constitute legal advice. Housing Hawk is not a law firm, and its employees, agents, and representatives are not acting as your attorneys. Our service is designed to offer general guidance and assist in apartment hunting based on the information you provide and our expertise in the real estate market.
16. Disclaimers Liability and Indemnification
YOU UNDERSTAND AND AGREE THAT YOUR USE OF THE WEBSITE, ITS CONTENT, AND ANY GOODS, DIGITAL PRODUCTS, SERVICES, INFORMATION OR ITEMS FOUND OR ATTAINED THROUGH THE WEBSITE IS AT YOUR OWN RISK. for a period of up to 2 years. Once this time period has expired, we will delete your data by removing you from our Wix database.

Our Company would like to send you information about products and services of ours that we think you might like, as well as those of our partner companies. Given that Housing Hawk has no partner companies as of now, we do not share your data with any other third party.

18. Governing Law
The Website and these Terms of Service will be governed by and construed in accordance with the laws of the Province of Quebec and any applicable federal laws applicable therein, without giving effect to any choice or conflicł of law provision, principle, or rule and notwithstanding. your domicile, residence, or physical location. Any action or proceeding arising out of or relating to this Website and/or under these Terms of Service will be instituted in the courts of the Province of Quebec, and each party irrevocably submits to the exclusive jurisdiction of such courts in any such action or proceeding. No failure to exercise, and no delay in exercising, on the part of either party, any right or any power hereunder shall operate as a waiver thereof, nor shall any single or partial exercise of any right or power hereunder preclude further exercise of that or any other right hereunder.
22 . Disclaimer of Liability for Tenant-Landlord Disputes:
Once a lease agreement has been signed between a tenant and a landlord facilitated through Housing Hawk, Housing Hawk shall not be held responsible or liable for any disputes, disagreements, claims, damages, or losses arising between the tenant and landlord, whether related to the terms of the lease, property condition, rent payments, property maintenance, or any other matter. Both parties acknowledge and agree that any disputes shall be solely between the tenant and landlord, and Housing Hawk shall not be a party to such disputes. Furthermore, the parties release Housing Hawk from any and all claims, liabilities, and demands arising out of or in connection with the lease agreement or any matters related thereto.
23. Notice
We may provide any notice to you under these Terms of Service by: (i) sending a message to the email address you provide to us and consent to us using; or (ii) by posting to the Website. Notices sent by email will be effective when we send the email and notices we provide by posting will be effective upon posting. Itis your responsibility to keep your email address current.
To give us notice under these Terms of Service, you must contact ust as follows: (i) by personal delivery, overnight courier or registered or certified mail to Housing Hawk, 2750 av kent, apartment 206, Montreal, Quebec, H3S 1M7, CA. We may update the address for notices to us by posting a notice on this Website. Notices provided by personal delivery will be effective immediately once personally received by an authorized representative of Company. Notices provided by overnight courier or registered or certified mail will be effective once received and where confirmation has been provided to evidence the receipt of the notice.
We hereby certify that the state of the apartment referred to in our certified report is accurate and valid only as of the date indicated in the report. Any changes made to the apartment after the date of the report are not within our knowledge and thus cannot be certified by us.
Please be informed that our company only acts as intermediaries between tenants and landlords. We do not have any control over the actions or decisions of either party. Our services only include apartment searches and visits, and we cannot guarantee that you will obtain the lease for any particular apartment.
Furthermore, it is possible that during the time between the apartment visit and the issuance of our certified report, another party may have taken the apartment you are interested in. As such, we cannot guarantee the availability of any apartment, even if it was available at the time of our visit.
